6.2 Delivery

We partner with reputable carriers including UPS, FedEx, DHL, and USPS. Once your order ships, you will receive a confirmation email with tracking information. Please note:

Risk of loss and title for purchased items pass to you upon our delivery to the carrier
We are not liable for delays caused by carriers, weather, natural disasters, customs clearance, or other circumstances beyond our reasonable control
Claims for damaged, lost, or stolen packages must be filed with the carrier directly, though we will assist as reasonable

6.3 International Orders

For international shipments:

You are responsible for all customs duties, import taxes, brokerage fees, and any other charges imposed by the destination country
We are not responsible for delays due to customs processing or clearance

7. Returns, Refunds, and Exchanges

7.1 30-Day Return Policy

Most products may be returned within 30 calendar days from the date of delivery, provided that:

7.2 Return Process

Receive RMA: We will provide a Return Merchandise Authorization number and return shipping instructions
Package Securely: Package the item securely with all original contents and include the RMA number
Ship the Return: Ship the package to the address provided using a trackable shipping method
Inspection and Refund: Upon receipt and inspection, we will process your refund within 7-10 business days

Returns received without a valid RMA number will not be accepted and will be returned to the sender at their expense.

7.3 Non-Returnable Items

The following items are not eligible for return:

Opened software, digital downloads, or license keys
Personalized, customized, or made-to-order items
Clearance or final-sale merchandise (marked as "Final Sale" on the product page)
Items damaged due to misuse, neglect, or improper installation
Items missing serial numbers, UPC codes, or original labels
Gift cards and store credit
Hygiene-related products where the seal has been broken (e.g., earphones, earbud tips)

7.4 Refunds

Refunds will be issued as follows:

Refunds are processed to the original payment method used for the purchase
Please allow 7-10 business days after we receive and inspect the returned item for the refund to post
Original shipping charges are non-refundable unless the return is due to our error
Return shipping costs are your responsibility unless the item is defective, incorrect, or damaged upon arrival
For PayPal payments, refunds will appear in your PayPal account balance

7.5 Defective or Incorrect Items

All other trademarks, registered trademarks, product names, and company names or logos appearing on the Site are the property of their respective owners. Nothing on the Site shall be construed as granting any license or right to use any trademark without the prior written consent of the owner.

8.3 Limited License

We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site for your personal, non-commercial purposes. This license does not include the right to:

By submitting User Content to the Site, you grant SlickPeak a perpetual, irrevocable, royalty-free, worldwide, non-exclusive, transferable, and sublicensable license to:

Use, reproduce, modify, adapt, publish, translate, and create derivative works from the User Content
Distribute, publicly display, and publicly perform the User Content in any media format
Use your name, likeness, and any other information you provide in connection with the User Content

We reserve the right, but have no obligation, to monitor, edit, or remove any User Content at our sole discretion, without notice.

10. User Conduct and Prohibited Activities

When using the Site, you agree not to engage in any of the following prohibited activities:

Illegal Activity: Using the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation

IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR CURRENCY OF ANY CONTENT, PRODUCT DESCRIPTIONS, OR PRICING INFORMATION
WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED
WARRANTIES REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USING THE SITE OR PRODUCTS

INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including but not limited to loss of profits, revenue, data, use, goodwill, or other intangible losses
DAMAGES ARISING FROM:
- Your use or inability to use the Site or Services
- Any conduct, content, or transactions on the Site
- Unauthorized access, use, or alteration of your transmissions or data
- Statements or conduct of any third party on the Site

NOTWITHSTANDING ANYTHING TO THE CONTRARY, SLICKPEAK''S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF:

The total amount you paid to SlickPeak for products purchased through the Site in the twelve (12) months preceding the event giving rise to the claim, OR
One Hundred United States Dollars ($100.00 USD)

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless SlickPeak Inc., its parent, subsidiaries, affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys'' fees and court costs) arising out of or relating to:

Your violation of these Terms of Service
Your use of the Site, Services, or Products
Your User Content, including any claims of infringement or violation of third-party rights
Your violation of any applicable law, rule, or regulation
Your fraudulent, negligent, or willful misconduct

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses.

15. Termination

15.1 Termination by Us

We reserve the right to terminate or suspend your account and access to the Site at any time, with or without cause, with or without notice, effective immediately. Grounds for termination may include:

Fraudulent, abusive, or illegal activity
Extended period of account inactivity

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms or any transactions conducted through the Site.

16.2 Informal Resolution

Before filing any formal legal action, you agree to first attempt to resolve any dispute informally by:

Engaging in good faith negotiations for at least sixty (60) calendar days

16.3 Binding Arbitration

Any dispute that cannot be resolved through informal negotiation shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted:

By a single neutral arbitrator

Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.

16.4 Class Action Waiver

ALL CLAIMS AND DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON''S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

16.5 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

17. Modifications to Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. When changes are made:

Material changes will be communicated to registered users via email at least 30 calendar days before taking effect

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

You may not assign or transfer these Terms, or any rights or obligations hereunder, without our prior written consent. We may assign, transfer, or delegate these Terms or any rights or obligations hereunder without restriction and without notice to you.

18.5 Force Majeure

We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government actions, power outages, internet disruptions, supply chain disruptions, or pandemics.

18.6 Relationship of the Parties

Nothing in these Terms shall be construed as creating a partnership, joint venture, agency, or employment relationship between you and SlickPeak.
